Terms and Conditions

Terms of Booking & Booking Deposit

By placing a booking with us  you (the lead guest) and your booking party (guests) agree to the following terms and conditions as set-out. During your stay you agree to abide by the subsequent conditions as set-out. If you have any questions about booking with us, please contact us before making a booking.

 

To place a booking with us the lead guest must be at least 18 years of age. The maximum number of staying guests per room is illustrated in the room occupancy details on the website and must not be exceeded. If you arrive and your party exceeds the occupancy you will be refused entry and will lose your payment. Travel cots can be provided for children UNDER  2 years old . Where the person making the booking is different to the lead guest taking up the occupation, the person making the booking may be held responsible for cancellation, non-arrival and damages as set-out within. Only the lead guest and the named booking party are allowed to use the property and its facilities, any third party visitors are only allowed access at our express permission and should vacate the site by 8pm to minimize disruption to other guests

To secure any booking we require a deposit to be paid in advance, this deposit amount is 30%

Deposit payments must be ‘cleared funds’ before a booking can be confirmed. Deposits non refundable.

Payments can be made online / over the phone using debit / credit card as well as by digital bank transfer, or cash deposit. Any charges raised against us by our banks for handling dishonoured bank transfers or any other payments, must be reimbursed by the lead guest within seven (7) days of any request to do so.

All guests agree to respect the privacy and peace of all other staying guests, neighbours and the owners at all times. We reserve the right to cancel a booking with immediate effect if guests are not honouring this agreement or causing a disturbance / nuisance to other guests, neighbours or the owners.

The property should only be used for  personal and domestic use only and should not be used  for any commercial purposes.

Sorry Barker Stakes does not accept bookings for large single sex groups, including “party” groups and  hen or stag parties.

We define a ‘group’ as a non family party of three or more . The holiday accommodation provide  has been selected with families and couples in mind .

VAT is included in the rental fee where applicable at the rate applicable on the date of payment.

Check-in & Check-out

Guests must check-in and check-out by the times stated below;

Check-in between 16.00 and 2100 on day of arrival

Check-out by: 10.30am on day of departure

Cancellation, & Non-Arrival Conditions

Guest who need to cancel a booking should contact us as soon as possible. Deposits already paid are non refundable

Cancellation made within 1 month for self catering  b results in full balance being charged.

Non-arrival guests, who are unable to attend or fail to attend for whatever reason forfeit their deposit paid and the full amount of the booking will be due. It is suggested that booking guests take out appropriate holiday / cancellation insurance where required.

In the rare event we need to cancel your booking with us, please be aware that we cannot be held liable for circumstances beyond our control and that our liability to you is limited to the refund of any payment already made.

WiFi Fair & Appropriate Usage Policy

Where WiFi Internet access is provided, guests accept to use this access to the Internet fairly and appropriately. We may monitor network performance and user usage in order to maintain a fair and high level of service to all our guests.

The Internet access provided is intended for general use such as access to the world wide web, email, messaging, social media, light video / music / media streaming. It is not intended or ideally suited for heavy media streaming, online gaming, extensive downloads / uploads. Access to illegal activity or use of our network for illegal activity is  prohibited and will be reported to local authorities.

Damages & Lost Property

We reserve the right to charge the lead guest for any damages caused through the course of a booking by any member of the booking party. This includes breakages, spillages, stains, damage to furniture or fixtures and fittings. Any accidental damages should be reported as soon as possible in order to minimise damage and associated costs. Lost keys / fobs / access cards will incur a replacement charge per key / fob / card lost. This will be charged to the card on which the booking was made.

Any lost property, if discovered and found, left behind by guests during a stay will be held for a period of 1 month. While we will make our best efforts to reunite lost property with their owners we accept no responsibility in replacing lost items and encourage guests to ensure they have all their belonging before checking-out. We may offer to post lost items via recorded delivery at the cost of the property owner, otherwise collection can be arranged.

Complaints
If there are any problems with the accommodation, contents or site, or you have any cause for concern during your stay,

you must notify us immediately to give us opportunity to rectify the matter. We cannot be held liable for faulty
services, equipment or appliances but will try to remedy any faults as soon as we can. In no circumstances can
correspondence be entered into regarding matters raised after your holiday has ended, or where we have been
denied the opportunity to try to put matters right during your stay.

Smoking

Smoking of any tobacco products including, but not limited to cigarettes, pipes, cigars, snuff or chewing tobacco, is only allowed in designated areas as sign posted throughout the accommodation and is in accordance with the Health Act 2006.

Pets & Service Dogs

We do  accept pets (max 2) in most  self catering lodges.

Sorry we do not accept pets in our cottages or the lodge that sleeps 3 people.

Service dogs are welcome in all rooms

Parking

Parking is available next to all lodges and in the main carpark for cottages. Please note that by booking  guests accept that they park their vehicles at their own risk.

Access to holiday property

We reserve the right to access the holiday property at any time during your stay. We will only do this should an emergency or serious issue occur.

Noise

Noise should be kept to a minimum between 10.30pm and 0800am

We can provide  an accessibility and access statement if required please contact us.

Hot tubs

Only guests staying in the lodge are permitted to use the hot tubs and must abide by the safety instructions provided. Pregnant  women and young children should avoid use of the hot tubs.

Your hot tub should be ready by 5pm on your day of arrival. We may empty it by 9.30am on your day of departure.

For bookings made on the day of arrival it may take upto 4 hours for your hot tub to be up to temperature. This is because when unoccupied the hot tubs are kept at a lower temperature.

Your Personal Details & Privacy

We are required to keep a register of guests over the age of 16 who stay with us, this includes full names and nationality, and/or passport numbers, place of issue, details of next destination if they are non-British, Irish or Commonwealth guests. This is in accordance with the (Immigration (Hotel records) Order 1972). These records are kept for a minimum of 12 months and in accordance with the DPA (Data Protection Act 1998) and the GDPR (General Data Protection Regulation).

Our policy surrounding the personal details you provide as part of any booking or enquiry through this website / or third party website, including the privacy of those details are explained and set out in our Privacy Policy which you can read here.

You accept that any entries you make to an on-site guest book, if available, will not contain personal information or details you would not want disclosed. Any entries containing personal details that may fall into the DPA and GDPR may be removed and destroyed.

 

Force Majeure
Force Majeure, of the nature of which this clause is intended to cover, includes without limitation fire, flood,
exceptional weather conditions, epidemics, destruction and damage of the Property by any cause other than
negligence of Barker Stakes, and all similar situations. No compensation, costs, expenses or other sums of any
description (including without limitation the cost of securing an alternative property/accommodation) will be
payable in such circumstances by Barker Stakes to the Guest.

Our Right To Cancellation

We reserve the right to cancel any booking without compensation, refund or reimbursement if the terms of these conditions are breached.

 

COVID-19 Addendum section
Contract

You are responsible for ensuring you comply with all government guidance relating to your stay, including, but
not limited to any localised lockdown and the number of households permitted to stay and/or socialise together.

 

Cancellation/Refund Policy
If the UK Government rules, specifically English Government rules, restrict movements, you may be asked to leave the
accommodation immediately, and pro rata  refunds will be issued.

If your booking has to be cancelled because either Barker Stakes is put under Government restrictions and has to
close or the address of the lead booker is put into local or regional lockdown meaning you are not permitted to
travel for your booked dates, we will transfer your deposit to a suitable date, or refund monies paid.
If our accommodation is open and you, the guests, are permitted to travel then your booking will proceed. You are
responsible for ensuring you comply with all government guidance relating to your stay, including, but not limited
to the number of households permitted to stay and/or socialise together both indoors and outdoors, by limiting
the guests staying at Barker Stakes or by booking additional accommodation.
Covid is also now a known risk and it is possible for you to make an informed decision about booking or possibly insure your holiday against it. This can include you, the
guests having Covid, or you, the guests having to isolate or quarantine, or you wishing to shield any of the guests.
We advise all our guests to have UK travel insurance to cover all eventualities. If you choose not to, then you
accept responsibility for any loss that you may incur due to your cancellation.

We recently stayed at Barker Stakes Holidays in one of the Waterside Bronze Lodges for 4 nights. The website will tell you this is one of the oldest and most basic accomodations but we found it to be perfect for us. On arrival we met Steve at reception, he checked that we were aware of the age of the lodge, which of course we knew and said it was fine. My hubby is mobility disabled and when I mentioned a wheelchair in the car Steve checked with me that my husband would be ok to go up steps to the lodge, very thoughtful. As we drove up to the lodge, you can park right next to the steps, we were greeted by the locals, a family of 5 ducks and 3 moorhens all young juveniles. Very cute and they appeared a few times every day and were very friendly, I named them, Daisy, Donald, Daisytwo, Dotty and Daphne. Most liked chopped up grapes but the duck food we bought in Thornton le Dale was very much enjoyed by them all. Dotty will even feed out of your hand (white spots on her beak). The lodge is entered by a double door into the sitting room with little dining table in one corner which has two windows either side of the corner, with a view of the pond and ducks, a leather sofa and chair in the other corners. TV had access to Netflix (don’t forget to sign out when you leave) and other streaming sites, electric fire which we didn’t use. Off this room is the kitchen, fast to heat hot water, electric oven and hob with a microwave, all of which we used and all worked perfectly. Fridge (small freezer section in the top of the fridge), Toaster and Kettle all used too. Complimentary beverages for arrival had been left, thank you, and cleaning and washing up items too. Towels in both rooms for two people and toilet roll too. All amenities had been thought of. Even a hoover, ironing board and as I discovered much too late, a hairdryer in one of the cupboards. A decent sized bathroom with curved shower and small sink to the left of the kitchen. Straight ahead the double bedroom that does have a door into the bathroom but this was stuck and couldn’t be opened fully, not a problem, not like it was a dozen steps to the other door. To the right of the kitchen was a back door access, we couldn’t get this to open, with a small hall, perfect for shoes. Then the twin bedroom. Both bedrooms had plenty of cupboards and drawers, dressing table in each and small wall heaters throughout the lodge so you don’t have to go cold. The hot tub is shielded by a laurel bush with an outside table and chairs to the other side. Very easy to operate, fold over the cover, over the bar and lift the bar to push it back against the fence. Even with my dodgy shoulder it was easy. Press a button for lights and another for bubbles, bliss. Only one day we didn’t go in the hot tub and that was because of the storm. We watched the sun go down and the moon rise, so peaceful and soul calming. I went for a walk on the last day to see the animals, 3 black piggies squealed with delight at head scratches but the goats and alpacas stayed away just staring. To get to the park you have to drive a long narrow road, be aware that some vehicles drive quicker, they obv know the roads, but its scary when you have to slam on and worry about pulling over for a passing place, of which there are plenty. Lidl was down the road and very easy to get to, shopping done. Flamingoland was 15min drive in one direction and Thornton le Dale also 15min drive in the opposite direction. Hubby was very excited to see the Bangers & Cash building there (from off tv) and we spent a good half hour in the shop. I can not recommend this lovely getaway enough, we will definitely be going back, both of us enjoyed it so much and I actually missed the ducks the first morning home. Husband and Wife owners were lovely and very welcoming. Thank you both for a lovely holiday.

Loved staying at Barker Stakes. Beautiful location. Very relaxing. Comfortable. If you want somewhere peaceful to stay this is the place. Loved being able to take our dog with us. Great play area and animals to look at if you have children. Steve very friendly and nothing too much for him. Already planning next visit

Absolutely stunning little place, so peaceful and amazing for the kids, we originally only stayed so we could go to flamingo land as it's over 5 hours away, but now we will back just to stay here, stunning!

Just returned from a lovely relaxing stay here. The lodge and hot tub were amazing and very private. Great location for days out in the moors and Whitby. The site itself was immaculate and so peaceful. Lovely little park area for children and games area as well. The site is well thought out and maintained to a very high standard. Our little one enjoyed seeing all the animals and walks round the site. We would definitely return. Thank you.

this was our third visit for the bank holiday weekend. Lovely to be back and again enjoyed our stay. Lovely clean lodge and hot tub. Perfect for any getaway and location is so quiet. Will be back to visit again.
